Terms of Service

By creating a Tryst account, you confirm that you:

- Are at least 18 years of age
- Have read, understood, and agree to these Terms of Service
- Have read and agree to our Privacy Policy
- Are legally permitted to use dating and social connection services in your jurisdiction

If you do not agree to these terms, you must not create an account or use the Tryst platform.

Tryst is a mystery date planning platform that uses AI-assisted matching to connect verified users and curate surprise first-date experiences.

What we provide: Profile matching, experience curation, venue booking facilitation, in-app communication tools, and safety features.

What we do not guarantee: Romantic or personal compatibility, the success of any date, the accuracy of any user's self-description, or the availability of any specific experience or venue.

Tryst is a platform facilitator. We are not responsible for the conduct of users or third-party vendors during or after a date experience.

Age requirement: You must be 18 years of age or older. We conduct mandatory age verification during onboarding. Providing false age information is a serious breach of these terms and will result in immediate permanent account termination and referral to relevant authorities where appropriate.

Identity verification: You must complete our identity verification process, which includes government ID upload and AI-assisted selfie matching. Your verified identity must match your profile self-description.

Background screening: You consent to a Nationally Coordinated Criminal History Check (NCCHC) conducted by our ACIC-accredited partner. Certain criminal convictions, particularly those involving violence, sexual offences, or offences against children, will result in permanent ineligibility to use the platform.

Honesty obligation: You must describe yourself accurately and honestly. Deliberate misrepresentation of your physical appearance, age, or identity ("catfishing") is a serious breach of these terms and will result in immediate permanent account termination.

You agree not to:

- Misrepresent your identity, appearance, age, or intentions
- Harass, threaten, stalk, or intimidate any other user
- Share another user's personal information without their consent
- Use the platform for commercial solicitation, escort services, or any illegal purpose
- Attempt to circumvent our safety or verification systems
- Create multiple accounts or share your account with others
- Use automated tools, bots, or scripts to interact with the platform

Violations of this section may result in immediate account suspension or permanent termination, and may be referred to law enforcement.

Your safety is your responsibility. While Tryst takes significant steps to verify users and screen for criminal history, no verification system is infallible. You should:

- Always meet in public places for first dates
- Tell a trusted person where you are going
- Use Tryst's live location sharing and safety check-in features
- Trust your instincts — you may cancel any date at any time

Reporting: You must report any user who makes you feel unsafe, harasses you, or misrepresents themselves. Reports are reviewed within 24 hours. We cooperate with the Australian Online Dating Code of Conduct cross-platform ban register.

Emergency: If you are in immediate danger, contact emergency services (000) immediately. Do not rely solely on in-app safety features in an emergency.

Subscription fees: Tryst Black Card subscription fees are charged monthly or annually in advance. Fees are displayed in Australian dollars (AUD) inclusive of GST.

Experience bookings: Experience booking fees are charged at the time of booking confirmation. A platform service fee of 15% applies to all bookings.

Refunds: You may cancel a booked experience up to 48 hours before the scheduled date for a full refund. Cancellations within 48 hours are non-refundable unless the cancellation is due to a safety concern reported through the app.

Australian Consumer Law: Nothing in these terms limits your rights under the Australian Consumer Law, including your right to a refund for services not delivered as described.

By you: You may delete your account at any time through the Settings page. Account deletion is permanent and irreversible.

By Tryst: We may suspend or permanently terminate your account without notice if you:

- Breach any provision of these terms
- Provide false identity or age information
- Are found to have relevant criminal convictions
- Engage in catfishing or deliberate misrepresentation
- Harass, threaten, or harm another user

Permanently terminated accounts are added to our internal ban register and, where applicable, the Australian Online Dating Code cross-platform ban register.

To the maximum extent permitted by Australian law, Tryst's liability for any claim arising from your use of the platform is limited to the total fees you have paid to Tryst in the 12 months preceding the claim.

We are not liable for: the conduct of any user, the quality or safety of any third-party experience or venue, any personal injury or property damage arising from a date experience, or any indirect, consequential, or incidental loss.

Nothing in this clause limits your rights under the Australian Consumer Law.

These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
